Terms not defined in this privacy policy will have the meaning ascribed to them in our terms of use.

Your privacy and the protection of information about you is important to The Park City Chamber of Commerce Convention and Visitor Bureau (PCCVB), also known as Visit Park City, and this is our Privacy Policy regarding your use of our websites (URL: www.visitparkcity.com and/or www.ParkCityChamber.com (individually and/or together, our “Website”). The purpose of this Privacy Policy is to inform visitors to our Website how information is collected, used, and shared and also describes your rights with respect to your information. We use third party operational service providers, website and communications support resources and other professionals in the operation, maintenance and support of our Website and when we refer to “PCCVB”, “us”, “we”, “our” or “ours” in this Privacy Policy, we are referring to and including those third parties.

What Does This Privacy Policy Cover?

This Privacy Policy only applies to information we obtain when you use our Website, whether you are online or using a mobile or wireless device. This Privacy Policy also provides information about your rights with respect to your Personal Information, and how you can reach us if you have questions about our privacy practices.

We use the term “Personal Information” to mean and refer to information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular person or household or that could uniquely identify a person, including you. Our Website may automatically collect, and store non-personal bits of information related to your use (more specifically described below). Although non-personally identifiable information is generally recorded in a way that does not reflect or reference any identifiable individual, the law may include this information within the definition of Personal Information because when taken together, non-personal bits of information could allow you to be identified. Personal Information does not include Personal Information that is deidentified or aggregated.

What Information Do We Collect?

If you submit Personal Information using our Website, whether you are subscribing to our e-newsletters, emails or other informational messages, requesting brochures, entering our promotions, filing out surveys or feedback forms, requesting proposals or any other information about us or our services, or for any other reason, the information we obtain will be stored in a secure data processing system (currently managed by Simpleview Inc,) and you are giving us permission and your consent to use your Personal Information to respond and communicate with you for purposes related to your submission.

If you consent to receiving emails, you will always be able to opt out by using the unsubscribe link at the bottom of each unsolicited marketing and promotional emails and/or if you consent to receiving SMS text messages you will always be able to revoke your consent and stop receiving SMS text messages by sending STOP to Short Code +1 (833) 610-3272 and in either case, by writing us at the address below in this Privacy Policy. Bear in mind that if you submit information because you are looking for employment, there are often specific legal rights and obligations that apply to Personal Information submitted and used for employment-related purposes. 

We currently use a number of third party operational service providers in various areas of our Website for, among other things, to manage our email communications and process our data. We want you to be able to review their privacy policies and in cases where they serve to manage any of our email communications, give you the ability to opt-out of receiving email communications if you choose:

Email marketing form member partners is facilitated through Constant Contact and you should review  Constant Contact's Privacy Policy which will allow you to opt-in and out of individual email lists or all marketing (commercial) communications.

Email marketing for meeting planners and other visitors is facilitated through MailChimp and you should review MailChimp's Privacy Policy which enables planners to opt-in and out of marketing (commercial) emails through their MailChimp Profile.

Although we may use third party operational service providers to conduct promotions (e.g., sweepstakes, contests) and surveys, we don’t allow them to use any Personal Information provided in connection with those activities for any purpose other than helping us administer these activities and we don’t share that information with any third parties unless otherwise clearly stated in the rules or terms that apply.

Non-personally identifiable information may include the type of Internet browser and operating system you are using, your IP address, the domain of the website you came from (sometimes called a referring URL), how many times and the dates and times of your visits and the average amount of time you spend on our Website. Technology may enable us to keep track of Website pages you visit, content your browser displays, determine when you search for particular words, as well as any Third Party Content (defined below) you may select (“click”), so we can better understand what content is popular and the subjects that interest visitors to our Website.

A “cookie” (i.e., a text file placed on your hard disk by a web page server) is an example of technology we may use to keep track of and capture information when you visit our Website, but there are different types of technology we may use that perform similar functions (e.g., pixel tags, server logs, invisible GIFs, web beacons, application data caches). In addition, there may be times (with varying degrees of accuracy), your location can be determined by your IP address, GPS, sensor data from your device or from nearby technology (e.g., Wi-Fi access points; cell towers; Bluetooth-enabled devices).  The capability to track and/or capture data and information often depends on your device location settings, which you generally have the ability to turn on or off. In addition, most browsers give you the ability to configure your settings to refuse cookies or indicate when a cookie is being sent.

Our Website does not support Do Not Track and we do not respond to Do Not Track requests. “Do Not Track” or “DNT” is a preference you can set in your browser to inform websites you do not want to be tracked. You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.

Google and its vendors use cookies to serve ads based on past visits to our Website and to provide us with information about how visitors engage with our Website. Your Age and Your Location

Our Website is not intended for children, and we do not knowingly collect information from anyone under the age of 13 (a “child”). If you are the parent, legal guardian or custodian of a child and determine or suspect we may have received any information from or about your child, please notify us immediately. We will confirm you are the parent, legal guardian or custodian and then promptly take steps to delete the child’s information anywhere it may be in our possession or under our control.

Our servers are primarily located in the United States, but we and our service providers may use cloud-based technology or servers that may be located in other jurisdictions in order to provide optimal experiences for users. If you are not a citizen or legal resident of the United States or your business is not incorporated, organized or otherwise a legally recognized entity in the United States, your country may not consider the privacy or data protection laws and regulations of the United States adequate. Consequently, if you choose to use our Website you are expressly consenting to and authorizing the export, transmission, storage, processing and use of your information, including Personal Information, to, from and within the United States of America, and you understand and agree your use of our Website will be subject to the provisions of this Privacy Policy, as well as the Federal and State laws and regulations applicable in the United States of America and not the laws, regulations or directives of any other jurisdiction.

Storing and Using your Information

We may store Personal Information on servers and storage media of ours or our service providers and we may share Personal Information in aggregate or anonymous form with third parties for storage purposes and to help gather statistics and Website analytics or to respond to your requests. Except for those whose separate privacy policies are relevant and are mentioned in this Privacy Policy, all other service providers with whom we share Personal Information are prohibited from using Personal Information and are required to treat and handle Personal Information, at a minimum, in a manner consistent with this Privacy Policy.

There are a number of purposes for which we use and retain information, including Personal Information, that we obtain and although some are already mentioned, they are worth repeating:

  • To help operate, administer, maintain and improve the quality and performance and operation of our Website and obtain analytical data and metrics so we can better understand how the Website is being used and improve your experience when using our Website;
  • To track outages or troubleshoot problems and detect, prevent and respond to possible fraud, abuse and security risks; 
  • To provide information or to contact you in response to your requests or otherwise as permitted by law;
  • To comply with our legal, regulatory and contractual obligations;

Your Personal Information may be accessed by our duly authorized employees and officers, for the purposes of the performance of their activities and to follow up on the above-mentioned purposes.

We always reserve the right to retain any of your Personal Information as long as necessary to fulfil and service any transactions or requests you have made or initiated that require our performance and for legal and audit purposes.  That said, we will only keep your Personal Information as long as necessary to achieve the purposes for which it was collected or for any other related and lawful purpose. In other words, if your Personal Information is obtained for more than one purpose, we will keep that information until the lengthier purpose is achieved. When keeping your Personal Information is no longer necessary, or if there is no longer any legal pre-condition for keeping it, your Personal Information will be irreversibly anonymized (and may be stored that way) or destroyed.

Sharing and disclosing Information

If you are a returning user, we may use your information to deliver targeted advertising to you when you visit our Website. Since many of these technologies ‘remember’ the websites you have visited and searches you have made using your browser, even when you visit other third party websites, the technology may allow and enable targeted advertising to appear that is related to your browsing and searching history. This is often referred to as “behavioral advertising” and is used to customize and deliver advertising we believe is more tailored to your personal interests and preferences. 

Except as specifically provided in this Privacy Policy, we do not share, sell, rent or lease any of your Personal Information to anyone, unless we have your permission. We may share and provide information to third parties, including information that may have been derived from Personal Information, for marketing, advertising, research or other uses, including, without limitation, aggregated information regarding activity on the Website, but we do so only in aggregated form that does not enable identification of any individual.

We always reserve the right and may use, preserve and/or disclose Personal Information of or about you in response to: (a) requests from local, state, or federal law enforcement officials; (b) judicial, administrative, or similar proceedings or orders, such as a subpoena; (c) a legal compulsion or requirement; and/or (d) to investigate suspected fraud, harassment, physical threats, or other violations of your Agreement with us, including our Website Terms of Use and this Privacy Policy, the rights of third parties, any law or regulation, or to investigate suspected conduct we reasonably determine is in violation of your Agreement with us.

In addition, we may disclose your Personal Information under the following circumstances:

  • If we are involved in a merger, acquisition, or sale of assets, we will continue to ensure the confidentiality of your Personal Information and give affected users notice before transferring any Personal Information or your becoming subject to a different privacy policy.

We will always ask for your consent before we use Personal Information for a purpose that isn’t covered by or provided for in this Privacy Policy and if we do provide Personal Information to third parties outside the scope of these criteria, we only provide aggregated, compiled or derivative information that doesn’t reveal or allow the identification of any individual person or their Personal Information. Even if we delete some or all of your information, unless prohibited by law or regulation, we may continue to retain and use your information, including Personal Information, as long as we have transformed, aggregated and anonymized it so that it cannot be identified to you or any other person.

You can appreciate, we also need to be sure your Personal Information isn’t accidentally or maliciously altered or deleted without your permission or knowledge, so if you ask us to delete all or any part of your information within your legal right to do so, there still might be some delay in deleting information in our systems and backups so we can make sure we can authenticate and properly follow your instructions.

You Can Control Your Privacy Choices

We want you to have choices and control over how we collect and use your Personal Information. If you contact us, ask us to provide you with information or receive unsolicited marketing or promotional emails from us, you will always be able to opt out of receiving those types of email communications from us in the future.

The exercise of any of the above rights is subject to certain exceptions provided by law that are intended to safeguard the public interest (e.g., prevention or identification of crimes) and our interests (e.g., maintaining security). Bear in mind only you or someone legally authorized to act on your behalf under the laws that apply to you is allowed to send us requests to exercise your rights. To protect your Personal Information, we will verify your identity by using a method appropriate to the type of request you are making. We may also request any authorized agent you may have designated to provide us with written permission from you to make requests on your behalf and we may need to verify your authorized agent's identity and your grant of authorization, in order to protect your Personal Information.

Your request must include enough information to enable us to verify you are the individual that is the subject of your request or to authenticate anyone else authorized to make the request on your behalf. You should describe your request, consistent with your rights, in enough detail so we can understand and respond to it properly and you should understand it will only cover the 12 month period preceding your verifiable and understandable request. If you don’t, or if we cannot verify your identity or the authority of another person to make the request on your behalf and make sure the request relates to your information, we will not be able to honor your request until you meet these conditions. We will generally respond to a complete and proper request, at no charge to you, within 45 days of receiving your verifiable and understandable request. If we need more time, we will notify you, but it won’t be longer than another 45 days. If we send you a digital file to allow for data portability, we will use a widely used file format which should allow you to transmit the information easily.

Links to Other Websites and Social Media

Our Website may contain Third Party Content (e.g., links to other websites that are not operated or controlled by us). If you select (e.g., mouse click) Third Party Content, you may be directed to that third party’s website and you visit those solely at your own risk. We strongly advise you to review the privacy policy of every website you visit because their terms of use and privacy policies will apply, not ours. We don’t monitor, evaluate, review or have any control over their content, privacy policies or practices or services and assume no responsibility for them.

If you choose to follow a link on our Website that leads to a social networking platform, depending on the social media platform and your settings, if you post or enter information or interact with the platform or others, your information may also be visible to others and again, you do so at your own risk. Once you leave our Website, your Personal Information and any activity or transactions you engage in will be under their control and subject to their policies, not ours.  Like all other third party links, we have no control over and are not liable or responsible for any use of your information by or through any social networking platforms.

Our Website may also contain videos from external platforms, which are video hosting, sharing, and services platforms (without limitation, but by way of example, YouTube, which is operated by YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066). These videos are embedded on our Website with the aid of a plugin – a program that allows you to view the videos directly through our Website. Although they appear on our Website, your browser is actually establishing a direct connection to the servers of those external platforms and they can detect the websites you have accessed, including our Website. If you have an account with an external platform, the platform owner may also be able to associate this information with your personal user account with them. You may be able to avoid this if you log out of your external platform account before viewing the videos (which use these plug-ins), but to be sure, you should consult the external platform privacy policy and their terms of use since that is the only source of accurate information regarding your rights and obligations associated with their websites and platform.

We maintain security measures and WE can update this privacy policy

Digital information that finds its way to the Internet, including the Worldwide Web, or that may be stored and maintained on devices that are interconnected to other devices or communications facilities, whether you voluntarily provide it or we gather it as a result of your activity on our Website, is often a target of cyber criminals.  As a consequence, although we maintain commercially reasonable security measures and try to keep track of known security threats and prevent problems before they occur, we cannot guarantee the security of your Personal Information transmitted electronically and we cannot promise that your use of our Websites or our services will be completely safe.

If our security measures can’t prevent these threats or problems, we try to detect and correct them promptly, in compliance with the laws and regulations that apply. We review Website information (e.g., logs and archive information) immediately before a problem starts to help us identify and fix problems more quickly. We also regularly review this Privacy Policy and our compliance with it, to make sure we keep up to date with our legal obligations.
